These Terms of Service ("Terms") govern your use of the Phoenix Rise website, mobile-friendly storefront, and in-store services (collectively, the "Services"). The Services are operated by Deck and Dagger Gaming, LLC, doing business as Phoenix Rise ("Phoenix Rise," "Company," "we," "us," or "our"), a Texas limited liability company.

By creating an account, placing an order, registering for an event, or otherwise using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

You may browse the Services without an account, but an account is required to check out faster, register for some events, track orders, and earn or redeem loyalty points. You're responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You must provide accurate, current information when creating an account and keep it up to date. We may suspend or terminate accounts that violate these Terms.

All payments are processed through Shopify Payments. We do not store your full card details. Prices are listed in US dollars and may change at any time without notice; the price charged is the price displayed at the time your order is placed, except in cases of pricing errors described below.

In the event a product is listed at an incorrect price due to a typographical, pricing, or system error, we reserve the right to cancel the order and issue a full refund, even after an order has been confirmed.

We reserve the right to refuse or cancel any order for any reason, including suspected fraud, unauthorized or illegal activity, or errors in pricing or product information.

Placing a pre-order reserves your allocation of a product ahead of its release date. No payment is taken at the time of reservation. Once the item arrives in store, we'll send you a secure payment link; your reservation is only finalized once that invoice is paid.

If you don't pay an issued invoice, your reservation may be cancelled and, at our discretion, your account may be restricted from placing future pre-order reservations.

Shipping rates, delivery estimates, and our return and refund policy are described in full on our Shipping & Returns page. That page is incorporated into these Terms by reference.

When you submit cards or sealed product to us for purchase through our buylist, offers are based on our staff's assessment of condition and current market value at the time of grading, which may differ from any online quote or estimate. We reserve the right to adjust an offer after physically inspecting submitted items, and to decline any submission.

Payment for accepted buylist submissions is made as store credit or cash/bank transfer, as selected at submission, once grading is complete.

Our loyalty program allows you to earn points on qualifying purchases and event attendance, redeemable for store credit. Points have no cash value, are non-transferable, and may be modified, capped, or discontinued at our discretion. We reserve the right to reverse points awarded in error or obtained through fraudulent activity.

Event registration, capacity, formats, and cancellation terms are set individually per event and shown at the time of registration. We reserve the right to modify, reschedule, or cancel an event, and to refuse entry or remove any participant for unsafe, disruptive, or unsportsmanlike conduct, without refund in the case of removal for cause.

You agree not to use the Services to violate any law, infringe on any intellectual property or other right, interfere with the operation of the Services, or attempt to gain unauthorized access to any account, system, or data.

All trademarks, logos, product images, and content on the Services are the property of Phoenix Rise or its licensors, or are used with permission, and may not be copied, reproduced, or used without prior written consent. Third-party trademarks (game titles, publisher logos, and card artwork) belong to their respective owners and are used for identification purposes only.

The Services are provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, Phoenix Rise is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Services, including but not limited to loss of data, loss of profits, or product unavailability.

Nothing in these Terms limits any right you have under applicable consumer protection law that cannot be lawfully limited.

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Services will be resolved in the state or federal courts located in Texas.

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date above. Continued use of the Services after a change constitutes acceptance of the revised Terms.
